The European Commission is officially stepping into the growing dispute over Denmark’s road usage tax fines. According to the transport organization International Transport Denmark (ITD), the Commission has requested an explanation from Danish authorities following widespread complaints from hauliers about unfair penalty practices.

Earlier this year, ITD filed a complaint to Brussels arguing that Denmark’s administration of the kilometer-based road tax violates EU law. The organization has maintained that vehicle owners were fined excessively for technical and system errors outside their control.

A Controversial Kilometer-Based Road Tax

The issue centers on Denmark’s new kilometer-based road tax for heavy vehicles, introduced at the start of the year. Figures from Sund & Bælt, the state-owned company managing the system, show that by the end of September 40,916 fines had been issued, totaling over 240 million Danish kroner. While the initial penalty for nonpayment was set at 4,500 kroner, it was doubled to 9,000 kroner on July 1.

ITD has now sued both the Ministry of Taxation and the Ministry of Transport, arguing that a fixed fine level fails to distinguish between innocent technical errors and intentional fraud. The group believes this approach breaches the EU’s proportionality principle, which requires penalties to reflect the seriousness of the offense.
